Terms of Service for CraftSnap

Welcome to CraftSnap! These Terms of Service ("Terms") govern your access to and use of the craftsnap.ai website (the "Site") and the services, features, content, and applications offered by CraftSnap ("we," "us," or "our") located at ul. Błękitna 9, 43-430 Skoczów, POLAND (collectively, the "Services"). Our contact email is cs@craftsnap.ai.

Please read these Terms carefully. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all these terms, then you may not access or use the Services.

1. Description of Service

CraftSnap provides an AI-powered service that transforms publicly available Instagram post content (URLs provided by you) and user-uploaded images into e-commerce product listing suggestions. The Services include content generation, AI enhancement features, and the ability to purchase credit packs for using these features.

2. User Accounts & Responsibilities

a. Account Creation and Security

To use most features of the Services, you must register for an account, managed through our third-party authentication provider, Clerk. You agree to provide accurate information and are responsible for safeguarding your account credentials and for all activities under your account. Notify us immediately at cs@craftsnap.ai of any unauthorized use.

b. Acceptable Use

You agree not to use the Services for any unlawful purpose or in any way that could harm CraftSnap or third parties. Prohibited actions include, but are not limited to:

Submitting content you do not have the rights to process.
Generating listings for illegal products, hate speech, or other objectionable content.
Attempting to reverse engineer or disrupt the Services.
Misusing or reselling credits in an unauthorized manner.

c. User Responsibility for Submitted Content

You represent and warrant that you own or have all necessary rights, licenses, consents, and permissions to submit any Instagram post URLs, images, or other content ("User Input") to the Services for processing and transformation. You agree that you will not submit any User Input that infringes upon or violates the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights. You are solely responsible for your User Input and the consequences of submitting it to and processing it through the Services. CraftSnap takes no responsibility and assumes no liability for User Input that you or any other user or third party posts or sends over the Service.

3. User Content & Intellectual Property

a. Your Content (User Input)

You retain all ownership rights to your User Input. By submitting User Input, you grant CraftSnap a limited, worldwide, non-exclusive, royalty-free license to use, process, reproduce, and modify such User Input solely for the purpose of providing and improving the Services to you.

b. Output Content

The product listing suggestions, AI-enhanced text, and other content generated by the Services ("Output Content") are provided for your use. You are solely responsible for reviewing the Output Content for accuracy, completeness, legality, and appropriateness before using it on any e-commerce platform or elsewhere. CraftSnap makes no warranties regarding the Output Content's fitness for a particular purpose, its originality, or its compliance with third-party platform policies. You are responsible for ensuring that your use of the Output Content does not infringe on any third-party rights.

c. CraftSnap Intellectual Property

The Services, including the Site, logos, visual design, and underlying technology (excluding User Input and specific AI model outputs which are subject to their providers' terms), are the exclusive property of CraftSnap and its licensors, protected by copyright, trademark, and other laws.

4. Credit Packs & Payments

a. Credit System

Certain features of the Services require "Standard Credits" or "Premium Credits" (collectively "Credits"). Credits can be obtained through promotional offers or by purchasing credit packs through the Site. Different features may consume different types or amounts of Credits, as specified within the Service.

b. Payment Processing

All payments for credit packs are processed by our third-party payment processor, Stripe. By making a purchase, you agree to Stripe's terms and conditions. You must provide valid and current payment information.

c. Pricing and Refunds

Prices for credit packs are displayed on the Site and are subject to change. Unless otherwise required by applicable law (such as specific consumer rights in the EU), all credit pack purchases are final and non-refundable. Unused Credits are non-transferable and do not expire unless explicitly stated otherwise. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

d. Taxes

You are responsible for paying any applicable taxes, duties, or governmental levies associated with your purchase of Credits.

5. Third-Party Services

The Services integrate with or rely on third-party services (e.g., Clerk, Stripe, Google Gemini AI, Apify, PostHog). Your use of these may be subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party services.

6. Service Availability & Modifications

We strive to keep the Services operational. However, all online services suffer occasional disruptions and outages. CraftSnap is not liable for any disruption or loss you may suffer as a result. We also reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice to you.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, CRAFTSNAP EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT THE OUTPUT CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, OR SUITABLE FOR YOUR NEEDS. ANY RELIANCE YOU PLACE ON SUCH INFORMATION OR OUTPUT CONTENT IS STRICTLY AT YOUR OWN RISK.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CRAFTSNAP, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICES OR ANY OUTPUT CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICES OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO CRAFTSNAP FOR CREDITS IN THE SIX (6) MONTHS PRIOR TO THE ACT, OMISSION OR OCCURRENCE GIVING RISE TO SUCH LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100.00).

9. Indemnification

You agree to defend, indemnify, and hold harmless CraftSnap and its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the Service, including any User Input you submit or Output Content you use; (b) your violation of any term of these Terms; or (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

10. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Services and any remaining Credits will cease. Provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Poland. For users within the European Union, this does not affect your mandatory statutory rights under the law of your country of residence. 12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material (as determined in our sole discretion), we will provide reasonable notice, such as by posting the updated Terms on the Site or sending an email notification. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.
